YOU MAY BE ELIGIBLE FOR AN ORDER OF NONDISCLOSURE
For most misdemeanors, there is no waiting period before you can
file a Motion for Nondisclosure.
For the following misdemeanor offenses there is a 5-year waiting
period:
There is a 10-year waiting period for felony offenses.
You are not eligible if:
- You must have plead guilty or no contest;
- You must have been placed on deferred adjudication;
- You must have been discharged from probation; and
- The charge must have been dismissed.
For most misdemeanors, there is no waiting period before you can
file a Motion for Nondisclosure.
For the following misdemeanor offenses there is a 5-year waiting
period:
- Kidnapping
- Assault
- Offenses involving family violence
- Disorderly conduct
- Weapons charges
There is a 10-year waiting period for felony offenses.
You are not eligible if:
- You are required to register as a sex offender;
- You plead to aggravated kidnapping;
- You plead to murder; or
- You committed an act of family violence.
