YOU MAY BE ELIGIBLE FOR AN ORDER OF NONDISCLOSURE

  • You must have plead guilty or no contest;
  • You must have been placed on deferred adjudication;
  • You must have been discharged from probation; and
  • The charge must have been dismissed.

For most misdemeanors, there is no waiting period before you can
file a Motion for Nondisclosure.

For the following misdemeanor offenses there is a 5-year waiting
period:
  1. Kidnapping
  2. Assault
  3. Offenses involving family violence
  4. Disorderly conduct
  5. Weapons charges

There is a 10-year waiting period for felony offenses.

You are not eligible if:
  • You are required to register as a sex offender;
  • You plead to aggravated kidnapping;
  • You plead to murder; or
  • You committed an act of family violence.
