FRIENDS DON'T LET FRIENDS PLEAD GUILTY TO
DRIVING WHILE INTOXICATED!
Houston DWI Attorney Paul B. Kennedy wants you to
know that the consequences of a DWI conviction on your
record can be severe:
- A $1,000 surcharge a year for your license renewal for
three (3) years
- Your auto insurance rates may be increased up to
300% for four (4) years
- A monthly probation fee for up to twenty-four (24)
months
- A $75 monthly fee for an Interlock device (if ordered)
- A minimum of three (3) days in jail; a maximum of 180
days
- Suspension of your drivers license for up to a year
- Missed time from work for multiple court dates
- Your reputation
- A criminal record for the rest of your life
A DWI conviction can easily cost you in excess of $10,000.
This figure does not include attorney's fees.
If you are arrested for DWI you only have fifteen (15) days to
appeal the suspension of your license. After 15 days you lose
your right to appeal the license suspension. You need to
contact an experienced DWI attorney immediately. Houston
DWI Attorney Paul B. Kennedy will handle your license
suspension hearing and, if your license is suspended, your
application for an occupational license.
Your license can be suspended for six months for refusing to
submit to a breath test or for three months if you have an
alcohol concentration of .08 or higher at the time of the test.
There is no deferred adjudication for a DWI conviction. Should
you plead "Guilty" that conviction will stay on your record
FOREVER. Make certain you consult with an experienced
DWI lawyer before entering a plea.
A second DWI conviction carries a minimum of thirty (30) days
in jail and a fine of up to $4,000.
Any prior DWI conviction, even one more than ten (10) years
old can be used to enhance a DWI. Two prior DWI convictions
and you're looking at a felony charge and the possibility of
real prison time. If you are charged with an enhanced DWI,
you need the help of an experienced DWI attorney.
If there is a child 14 years old or younger in the car at the time
you are arrested, a DWI becomes a state jail felony,
punishable by up to 2 years in jail.
The Harris County District Attorney's Office has announced a
program in which some first-time DWI offenders will be eligible
for pretrial diversion. If you've been charged with DWI, contact
Houston DWI Attorney Paul B. Kennedy to discuss your
options and whether a pretrial diversion might be right for you.
Houston DWI Lawyer Paul B.
Kennedy asks "Did you know?"
The amount of alcohol in the sample
chamber for a .08 alcohol concentration is
only 1/1,000,000 of an ounce!
The Intoxilyzer 5000 does not take mouth
alcohol into account when measuring your
BAC. It may take up to 20 minutes for mouth
alcohol to dissipate.
Test results from an Intoxilyzer 5000 breath
machine may be unreliable due to any of the
following:
- Petroleum-based fumes
- Mouth alcohol
- Dental appliances
- Gastric reflux disorders
- Gastric bypass surgery
- Atkins diet
- Airbag deployment
- Mechanical problems with the breath
test machine
- Operator error
- Problems with the computer source
code
- Problems with the reference sample
device (alcohol jar)
Do you really want a machine that no one can
describe how it works to decide your fate?
